IV. HOW WE USE YOUR PERSONAL INFORMATION
We use Order Information generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: communicate with you and provide customer service; screen our orders for potential risk or fraud; and provide you with information or advertising relating to our products or services or your prior purchases, in accordance with the preferences you have shared with us.
We use Device Information to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns). We also use Device Information to provide you with information or advertising relating to our products or services, in accordance with the preferences you have shared with us. V. SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with third parties to help us use it for the purposes described above. For example, we use Shopify to power our online store and share Device Information and Order Information with Shopify. Shopify may process your Personal Information when you visit or make purchases in our online store, including to provide services based on your interactions with other merchants and with Shopify. We also share your Personal Information, including Device Information, Marketing Information, and Order Information, with Google Analytics and similar third-parties (including for example Meta and Disco) to help us understand how our customers use the Site. We use and share your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. This use includes sharing your Personal Information with third-party advertising partners (including for example Google Ads, Meta, TikTok, Amazon). We may also share these categories of Personal Information with these third parties using “third-party cookies” that they install on your device. We also share your Personal Information with our third-party service providers, in order to perform business functions such as fulfilling or shipping your orders, customer service, hosting services, communications, software and website development services, payment processing services, accounting and audit services, compliance services, quality control services, and analytics services. Unless otherwise noted in this Privacy Policy, our third-party service providers are only allowed to use, disclose, or retain your Personal Information for the purpose of providing these services to us, and are prohibited from selling your Personal Information.
We will not share your opt-in to an SMS campaign with any third-party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Information, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.
Finally, we may also share your Personal Information to comply with applicable laws and regulations, to prevent fraud, to respond to a subpoena or other lawful request for information, or to otherwise protect our rights or the rights of others. VI. HOW WE PROTECT YOUR PERSONAL INFORMATION
We maintain generally accepted industry standards to protect the Personal Information that we collect from unauthorized access or disclosure. We never have access to your credit card information, as it is tokenized following PCI-compliant standards.
While we strive to protect your Personal Information and privacy, no data transmission or storage is 100% safe. We cannot guarantee or warrant the security of any information disclosed or transmitted to us and cannot be responsible for the theft, destruction or inadvertent disclosure of Personal Information.
VII. RETAINING AND DELETING YOUR PERSONAL INFORMATION
We do not retain Personal Information for longer than reasonably necessary to fulfill the business purposes for which it was collected, conduct audits, enforce our legal rights, prevent fraud and ensure security, or comply with our legal obligations. Our retention periods for Personal Information vary depending on the nature of our relationship with you, the sensitivity of the Personal Information, and the risks involved with any related processing. VIII. CHILDREN’S PRIVACY

Exercising your state privacy rights:

To protect your Personal Information, we are required to verify that any person making a request under this section is in fact you or your authorized agent. To verify the identity of the person making a request, we may ask you to provide the following information: your email address and prior order or payment information. We will use this information only for the purposes of verifying that your request is authentic.
Once we receive your request, we will respond within 10 business days and inform you if we need any more information to verify your request. We will provide the information you requested within 45 days of your request. If we require more than 45 days to respond to your request, we will inform you of the reasons why. For requests from California consumers to opt out of the sale or sharing of their Personal Information for the purposes of cross-context behavioral advertising, or requests to limit the use of sensitive Personal Information, we will respond within 15 days.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive or manifestly unfounded.
Exercising privacy rights as the resident’s authorized agent:
If you are a consumer and you would like to authorize an agent to submit requests on your behalf, to exercise your rights under the state privacy laws listed herein, please designate your authorized agent by filling out the form found here. Alternatively, you may authorize an agent by contacting us at the addresses and phone number listed above.
When possible, we will compare the identifying information you provide with the Personal Information we already have in our systems. Generally, we will refrain from requesting additional information for verification purposes. Only when we cannot verify your identity or residency based on the information in our possession will we seek additional information from you. The supplementary Personal Information collected will be used solely for the accurate verification of your identity to facilitate the exercise of your privacy rights, and to prevent fraud.
If you are an account holder with us, we will request your email address. However, in cases where we suspect fraudulent or malicious activity on a password-protected account, we will not fulfill requests to know or delete Personal Information until additional verification procedures have been successfully completed. For individuals who do not have an account with us, we will ask for specific data points that enable us to reasonably verify your consumer request.
Exercising the right to know. If you are requesting to know the categories of Personal Information collected, we may require two data points to be provided by you that match two of the data points that we maintain. But if you request to know specific pieces of information or obtain a copy of that information, a higher bar for verification is required, which may require us to match three data points of information provided by you with three data points that we maintain in our records, together with a signed declaration under penalty of perjury that you are the individual whose Personal Information is the subject of the request. We will maintain all signed declarations as part of our record-keeping obligations under state privacy laws.
Exercising the right to delete. When you make a request to delete your Personal Information, the level of reasonable certainty required during our verification process will vary depending on the nature of the Personal Information you wish to have deleted. We will gather the necessary data points required to verify your identity to a reasonable degree of certainty, which may require verifying three data points. We will act in good faith when determining what standard to apply when verifying all consumer requests.
You may designate an authorized agent to act on your behalf to make a privacy request. If you use an authorized agent to submit privacy requests (aside from requests to opt-out of targeted ads, sales, or sharing and/or requests to limit the use of Sensitive Personal Information – which do not require verification), we may ask you to provide the following information: your email address and prior order or payment information. We may also require written and signed authorization from you before an agent may act on your behalf. We will use this information only for the purposes of verifying that your request is authentic.
Your right to appeal our response to your privacy rights requests:
Residents of Colorado, Connecticut, Indiana, Kentucky, Minnesota, Montana, New Jersey, Oregon, Texas, and Virginia have the right to appeal our decisions in response to your privacy rights requests. To initiate an internal appeal, please contact us at the addresses or phone number listed above or by filling out the form found here. We will respond to your request for an internal appeal within 45 days, but we may take up to 60 additional days for good cause. If you are unhappy with the results of your appeal, you may contact your state attorney general.
